Assam DGP Ordered by Meghalaya High Court to Take Action Against Accused of Illegal Coal Mining

Meghalaya, July 07, 2023: In a significant development, the Meghalaya High Court has issued a directive to the Director General of Police (DGP) in Assam, urging him to take decisive action against individuals allegedly involved in illegal coal mining and transportation in Meghalaya. Furthermore, the court has emphasized the need to ensure the safety of the petitioners involved in the case.

This order comes on the heels of the high court’s previous decision to issue a show cause notice to the Meghalaya government. The notice questioned why the Central Bureau of Investigation (CBI) should not be tasked with investigating the illegal mining and utilization of coal, particularly as the operations appear to be under the control of individuals based in Assam.

During the hearing of a Public Interest Litigation (PIL), a full bench of the court, presided over by Chief Justice Sanjib Banerjee, directed the Assam DGP to thoroughly examine the complaint filed by the petitioner on June 30, 2023. The court emphasized the importance of taking appropriate legal steps in response to the complaint.

The petitioner had lodged a First Information Report (FIR) at Basistha Police Station, alleging that a key figure involved in the illicit activities of coke plants in Meghalaya had contacted and even visited the petitioner’s residence. The alleged purpose of the visit was to issue threats and deter further pursuit of the petition.

The Meghalaya High Court further instructed the Assam DGP to ensure the safety and security of the petitioners, as well as their family members and legal representatives.

A majority of the petitions pertaining to illegal coal mining and transportation are scheduled for another hearing on July 13, where the court will address the matters once again.
