Agartala, December 30, 2024: The Tripura High Court has called for strict adherence to the Prevention of Cruelty to Animals Act, 1960, its associated rules, and guidelines issued by statutory authorities. The division bench comprising Chief Justice Aparesh Kumar Singh and Justice Biswajit Palit directed the state authorities to recirculate these guidelines among field officers to prevent future violations at the ground level.
The Court was hearing a Public Interest Litigation (PIL) filed by an advocate and animal rights activist affiliated with the NGO “Society for Welfare of Animal and Nature (SWAN).” The petitioner highlighted an incident on July 25, 2024, at Kamrangabari, Kailashahar, where cattle, including cows, calves, and bulls, were allegedly transported in violation of the Act and related rules. Despite a local activist’s complaint and police intervention, the seized cattle and vehicle were reportedly released without following the prescribed legal procedures.
The petitioner also alleged attempts to pressure the complainant into withdrawing the case. The Government Advocate informed the Court that disciplinary action had been taken against the inspector involved, including a final warning issued by the Superintendent of Police, Unakoti District, on November 22, 2024. The authorities assured the Court of future compliance with the law.
“We are of the considered view that the Act of 1960, the Rules framed there under, and the guidelines issued from time to time by the statutory authorities must be observed scrupulously at all levels by the concerned authorities,” the bench emphasized.
The Court directed the state to ensure that all officers adhere to the legal framework, reiterating the importance of protecting animal welfare through strict enforcement of existing laws.
